By accessing or using SS Courier N Cargo services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy and Service Guidelines.

1.2 Definitions

  • "Company," "We," "Us," "Our" refers to Shivra & Shivaay Enterprises Private Limited (SS Courier N Cargo)
  • "Customer," "You," "Your" refers to the person or entity using our services
  • "Shipment" refers to the package, parcel, or cargo being transported
  • "Services" refers to all courier, logistics, and related services provided by us
  • "Consignor" refers to the sender of the shipment
  • "Consignee" refers to the receiver of the shipment

1.3 Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

2. Service Usage

2.1 Eligibility

You must be at least 18 years old to use our services. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2.2 Account Registration

Some services may require you to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

2.3 Service Availability

3. User Responsibilities

3.1 Accurate Information

  • Correct sender and receiver addresses with PIN codes
  • Valid contact numbers
  • Accurate description of shipment contents
  • Correct declared value of goods
  • Proper packaging and labeling

3.2 Packaging Requirements

You must ensure that all shipments are properly packaged to withstand normal handling during transit. We are not liable for damage resulting from inadequate packaging.

3.3 Compliance with Laws

You agree to comply with all applicable laws, regulations, and customs requirements. You are responsible for obtaining any necessary permits, licenses, or documentation required for your shipment.

4. Prohibited Items

4.1 Strictly Prohibited

The following items are strictly prohibited from being shipped through our services:

  1. Illegal drugs, narcotics, and controlled substances
  2. Explosives, fireworks, and ammunition
  3. Weapons, firearms, and sharp objects
  4. Flammable liquids and gases
  5. Hazardous chemicals and toxic materials
  6. Live animals and plants
  7. Radioactive materials
  8. Cash, currency, and negotiable instruments
  9. Pornographic and obscene materials
  10. Counterfeit goods and pirated products
  11. Human remains and biological samples
  12. Antiques and artifacts without permits
Violation Consequences

Shipping prohibited items may result in shipment confiscation, legal action, account termination, and you may be held liable for any resulting damages or penalties.

4.2 Restricted Items

The following items may be shipped only with prior approval and proper documentation:

  • Lithium batteries and power banks
  • Perfumes and alcoholic beverages (limited quantity)
  • Jewelry and precious metals
  • Medicines and pharmaceuticals (with prescription)
  • Perishable food items (with proper packaging)

5. Pricing & Payment

5.1 Service Charges

Prices for our services are based on factors including weight, dimensions, distance, service type, and delivery speed. All prices are subject to change without prior notice.

5.2 Payment Terms

  • Payment must be made before or at the time of shipment pickup
  • We accept cash, credit/debit cards, UPI, and online transfers
  • Corporate clients may be eligible for credit facilities subject to approval
  • All prices are inclusive of applicable taxes unless stated otherwise

5.3 Additional Charges

Additional charges may apply for:

  • Remote area delivery
  • Oversized or overweight shipments
  • Special handling requirements
  • Storage fees for unclaimed shipments
  • Return shipping costs
  • Customs duties and taxes (for international shipments)

5.4 Refunds

Refunds are processed only in cases of service failure or cancellation before pickup. Refund requests must be made within 7 days with proper documentation. Processing time is 10-15 business days.

6. Delivery & Liability

6.1 Delivery Commitment

We make reasonable efforts to deliver shipments within the estimated timeframes. However, delivery times are estimates and not guarantees. We are not liable for delays caused by:

  • Natural disasters, weather conditions, or acts of God
  • Government restrictions or regulatory actions
  • Strikes, lockouts, or labor disputes
  • Incorrect or incomplete address information
  • Unavailability of the receiver
  • Customs delays (for international shipments)

6.2 Delivery Attempts

We will make up to three delivery attempts. If the receiver is unavailable on all attempts, the shipment will be held at our facility for 7 days for self-pickup. After that, it will be returned to the sender at the sender's expense.

6.3 Proof of Delivery

Delivery is considered complete upon obtaining a signature from the receiver or authorized person. By signing, the receiver acknowledges receipt of the shipment in good condition.

6.4 Limitation of Liability

Our liability for loss, damage, or delay is limited to:

  • The lesser of the actual value or declared value of the shipment
  • Maximum of ₹5,000 unless additional insurance is purchased
  • We are not liable for indirect, consequential, or special damages
  • No liability for delays in delivery unless explicitly guaranteed in writing
Insurance Recommendation

We strongly recommend purchasing cargo insurance for high-value shipments to ensure adequate coverage in case of loss or damage.

7. Claims & Disputes

7.1 Filing Claims

Claims for loss, damage, or delay must be filed within:

  • 7 days from the date of delivery (for damage claims)
  • 14 days from the shipping date (for lost shipment claims)
  • 30 days for delayed delivery claims

7.2 Claim Requirements

To file a claim, you must provide:

  • Original shipping receipt or tracking number
  • Photographs of damaged packaging and contents
  • Invoice or proof of value
  • Detailed description of the issue
  • Original packaging (for damage claims)

7.3 Claim Processing

All claims will be investigated and processed within 15-30 business days. We reserve the right to inspect the shipment and packaging before approving any claim.

7.4 Dispute Resolution

Any disputes arising from our services will first be attempted to be resolved through good faith negotiation. If unresolved, disputes will be subject to arbitration in accordance with the laws of India.

8. Privacy & Data Protection

8.1 Data Collection

We collect and process personal information necessary to provide our services, including names, addresses, contact details, and shipment information. Please refer to our Privacy Policy for detailed information.

8.2 Data Usage

Your information may be used for:

  • Processing and delivering shipments
  • Customer service and support
  • Billing and payment processing
  • Marketing communications (with your consent)
  • Compliance with legal obligations

8.3 Data Security

We implement appropriate security measures to protect your personal information. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

9. Intellectual Property Rights

9.1 Ownership

All content on our website and mobile applications, including logos, trademarks, text, graphics, and software, are the property of Shivra & Shivaay Enterprises Private Limited and protected by intellectual property laws.

9.2 Restrictions

You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or logos without authorization
  • Reverse engineer or decompile our software

10. Termination

10.1 Termination Rights

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for:

11. Governing Law & Jurisdiction

11.1 Applicable Law

These Terms are governed by the laws of India. Any legal proceedings arising from these Terms will be subject to the exclusive jurisdiction of courts in New Delhi, India.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

11.3 Entire Agreement

These Terms, along with our Privacy Policy and Service Guidelines, constitute the entire agreement between you and SS Courier N Cargo regarding the use of our services.
